This offer is addressed to any persons hereinafter referred to as the «Customer», and is an official proposal of the Federal State Budgetary Educational Institution of Higher Education «Bauman Moscow State Technical University (National Research University)», hereinafter referred to as the «Contractor», represented by the Head of the Scientific Educational Complex of Fundamental Sciences of Bauman Moscow State Technical University, Gladyshev V.O., acting on power of attorney No. 11 dated December 31, 2022, to conclude an agreement for conditions specified in the offer.

This offer is an agreement for the provision of services for organizing the participation of the Customer in the International Conference «Physical Interpretations of Relativity Theory PIRT -2023» and is concluded by its acceptance in the manner established by the Civil Code of the Russian Federation, and regulates the procedure for the provision of the specified services and obligations by the Contractor, arising between the Contractor and the Customer. 1. CONCEPTS AND DEFINITIONS USED IN THE OFFER

1.1. Offer — a proposal of the Contractor to conclude an agreement indicating all the conditions necessary for this (clause 2 of article 437 of the Civil Code of the Russian Federation).
1.2. Offer acceptance — full and unconditional acceptance of the Offer by performing the actions specified in it. Acceptance of this Offer means that the Customer agrees with all the conditions for the provision of services, acceptance is tantamount to concluding an agreement in accordance with the norms of the Civil Code of the Russian Federation (clause 3 of article 438 of the Civil Code of the Russian Federation).
1.3. Offer validity — the period established by the Contractor for the Offer Acceptance.
1.4. Conference — International Conference «Physical interpretations of the Theory of Relativity PIRT-2023».
1.5. The Conference website — an information resource of the Contractor on the Internet, available at: https://pirt.bmstu.ru/.
1.6. Application — an electronic appeal of the Customer (Customers) to the Contractor providing the Contractor with the necessary data (last name, first name, patronymic of the participant, information about the academic degree and rank, place of work, and position, phone number, email address, participation form and information on payment of the registration fee) to organize the participation of the Customer in the Conference. The application is generated automatically when filling out and sending an electronic form on the Conference website.

2. SUBJECT OF THE OFFER

2.1. The Contractor undertakes to organize the participation of the Customer in the Conference

on the terms of this offer (hereinafter — «Services»).
2.2. Services are provided by the Contractor at the venue of the Conference: Moscow, Rubtsovskaya embankment, bld. 2/18 (Educational and Laboratory Building of Bauman Moscow State Technical University).
2.3. The Customer undertakes to pay for the Contractor’s Services in accordance with the terms of this offer.

3. RIGHTS AND OBLIGATIONS OF THE PARTIES

3.1. The Contractor is obliged to:

3.1.1. Provide the Customer with Services in accordance with the terms of this offer and within the time of the Conference. The List of services and the cost of the organizational fee for such Services, as well as the application form for Participation in the Conference, are on the Contractor’s website https://pirt.bmstu.ru/.

3.1.2. Respect the rights of the Customer as provided for by the current legislation, as well as protect them and take all necessary measures to prevent copyright infringement by third parties. 3.2. The Contractor has the right to:
3.2.1. Store and process the following personal data of the Customer without any time limit:

— full name;
— postal address, e-mail address, telephone number;
— information about education;
— information about the place of work and the position held.

Personal data are provided for their storage and processing in various databases and information systems, their inclusion in analytical and statistical reports, etc.
3.2.2. Send letters to the Customer to his email address, as well as send the Customer to his mobile phone number specified in the Application, SMS messages with information containing information about the events held by the Contractor.

3.3. The Customer is obliged to:
3.3.1. Pay the registration fee for participation in the International Conference «Physical Interpretations of Relativity Theory PIRT-2023» in accordance with the prices indicated on the website https://pirt.bmstu.ru/ in the «Basic Information» section by bank transfer of funds to the account of the Contractor, the commission for the transfer of funds is debited from the Customer’s account. Payment is made before the end of the period specified on the website https://pirt.bmstu.ru/ in the «Basic Information» section.
3.4. The Customer has the right to:
3.4.1. Withdraw consent to share his personal data with a third party by sending a written notice to the Contractor.
3.4.2. Refuse to participate in the Conference before its start date indicated on the website: https://pirt.bmstu.ru/.

4. ACCEPTANCE OF THE OFFER AND CONCLUSION OF THE AGREEMENT

4.1. The Customer makes the Offer Acceptance by ticking «I agree with the terms of the public offer» and by clicking «Submit application» on the website: https://pirt.bmstu.ru/.
4.2. The Offer is considered accepted by the Customer and the Agreement concluded by the Parties from the moment the Customer completes the set of the following actions:
a) Submitting an application for participation in the Conference in electronic form on the Conference website. The submission of the application is the basis for invoicing the ordered services.

b) Paying for the Contractor’s services during the Offer Term specified in clause 5.1 of this Agreement.

5. PERIOD OF VALIDITY AND CHANGE OF TERMS OF THE OFFER

5.1. The Offer comes into force from the moment of its publication on the Internet address https://pirt.bmstu.ru/ and is valid until the Offer is revoked by the Contractor.

6. TERM AND AMENDMENT OF THE AGREEMENT

6.1. The Agreement comes into force from the moment the Offer is accepted by the Customer and is valid until the Parties fulfill their obligations;
6.2. The Contractor agrees and acknowledges that making changes to the Offer entails the introduction of these changes into the contract concluded and ongoing between the Contractor and the Customer, and these changes come into force simultaneously with such changes in the Offer.
6.3. If the Offer is revoked by the Contractor during the term of the agreement, the latter is considered terminated from the moment of the revocation. Services paid by the Customer at the time of the revocation of the Offer are subject to execution in full.

7. COST OF SERVICES AND PAYMENT PROCEDURE

7.1. The List of the Contractor’s Services is indicated on the Conference website: https://pirt.bmstu.ru/ and depends on the type and number of the Services provided by the Contractor. The Services are 100% prepaid by transferring funds to the account of the Contractor no later than the Offer validity period, with the obligatory indication in the receipt/ payment order of the last name, first name, and patronymic of the Customer (Customers) participating in the Conference.
7.2. When paying for the Services in the Receipt, the Customer indicates the following as the purpose of payment: “Payment for the Services for participation in the PIRT-2023 Conference, without VAT».
7.3. The cost of the Services for participation in the Conference includes the provision of handouts to the Customer and the organization of a coffee break.

8. TERMINATION OF THE CONTRACT

8.1. The Contract can be terminated early:
8.1.1. By agreement of the Parties at any time;
8.1.2. On other grounds provided for by this Offer.
8.2. Termination of the Contract for any reason does not release the Parties from liability for violations of the terms of the Contract that arose during its validity.

9. LIABILITY OF THE PARTIES

9.1. The Customer and the Contractor bear, in accordance with the current legislation of the Russian Federation, property and other legal responsibility for non-fulfillment or improper fulfillment of their obligations under this agreement.
9.2. A Party that has improperly performed or failed to fulfill its obligations under this agreement is obliged to compensate for losses caused to the other Party.

10. FINAL PROVISIONS

10.1. The claim procedure for the pre-trial settlement of disputes from this agreement is mandatory for the Parties.
10.2. The letters of claim are sent to the Contractor by email dekan-fn@mail.ru, to the Customer — to the email address specified in the application.

10.3. The term for consideration of a claim letter is 10 working days from the date of receipt of the latter by the addressee.
10.4. This agreement comes into force from the moment the Customer accepts the offer on the Contractor’s website.

10.5. In everything that is not provided for by this agreement, the Parties are guided by the norms of the current legislation of the Russian Federation.

Настоящая оферта адресована любым лицам, именуемым в дальнейшем «Заказчик», и является официальным предложением федерального государственного бюджетного образовательного учреждения высшего образования «Московский государственный технический университет имени Н.Э. Баумана (национальный исследовательский университет)», именуемого в дальнейшем «Исполнитель», в лице руководителя Научно-учебного комплекса «Фундаментальные науки» МГТУ им. Н.Э. Баумана Гладышева Владимира Олеговича, действующего на основании доверенности No 11 от 31 декабря 2022 г., заключить договор на указанных в оферте условиях.

Настоящая оферта является договором на оказание Услуг по организации участия Заказчика в международной конференции «Физические интерпретации теории относительности PIRT-2023» и заключается путем ее принятия (акцептирования) в порядке, установленном Гражданским кодексом Российской Федерации, и регламентирует порядок предоставления Исполнителем указанных услуг и обязательств, возникающих между Исполнителем и Заказчиком. 1. ПОНЯТИЯ И ОПРЕДЕЛЕНИЯ, ИСПОЛЬЗУЕМЫЕ В ОФЕРТЕ

1.1. Оферта – предложение Исполнителя заключить договор с указанием всех необходимых для этого условий (п. 2 ст. 437 ГК РФ).
1.2. Акцепт Оферты – полное и безоговорочное принятие Оферты путем осуществления действий, указанных в ней. Акцепт данной Оферты означает, что Заказчик согласен со всеми условиями оказания услуг, акцепт равносилен заключению договора в соответствии с нормами Гражданского кодекса Российской Федерации (п. 3 ст. 438 ГК РФ).
1.3. Срок действия оферты – срок, установленный Исполнителем, для Акцепта Оферты. 1.4. Конференция – Международная конференция «Физические интерпретации теории относительности PIRT-2023».
1.5. Сайт конференции – информационный ресурс Исполнителя в сети Интернет, доступный по адресу: https://pirt.bmstu.ru/.
1.6. Заявка – электронное обращение Заказчика (Заказчиков) к Исполнителю с предоставлением Исполнителю необходимых данных (фамилия, имя, отчество участника, сведения об ученой степени и звании, место работы и должность, номер телефона, адрес электронной почты, форма участия и информация об оплате организационного взноса) для организации участия Заказчика в Конференции. Заявка формируется автоматически при заполнении и отправке электронной формы на Сайте Конференции.

2. ПРЕДМЕТ ОФЕРТЫ

2.1. Исполнитель обязуется организовать участие Заказчика в Конференции на условиях настоящей оферты (далее – «Услуги»).
2.2. Услуги оказываются Исполнителем в месте проведения Конференции: г. Москва, Рубцовская набережная, д. 2/18 (Корпус УЛК МГТУ им. Н.Э. Баумана).
2.3. Заказчик обязуется оплатить Услуги Исполнителя в соответствии с условиями настоящей оферты.

3. ПРАВА И ОБЯЗАННОСТИ СТОРОН

3.1. Исполнитель обязан:
3.1.1. Исполнитель обязуется оказать Заказчику Услуги в соответствии с условиями настоящей оферты и в рамках времени проведения Конференции. Программа (Перечень) услуг и стоимость организационного взноса за такие Услуги, а также форма заявки для Участия в Конференции расположены на сайте Исполнителя https://pirt.bmstu.ru/.
3.1.2. Соблюдать предусмотренные действующим законодательством права Заказчика, а также осуществлять их защиту и принимать все необходимые меры для предупреждения нарушения авторских прав третьими лицами.
3.2. Исполнитель имеет право:
3.2.1. Хранить и обрабатывать следующие персональные данные Заказчика без ограничения по сроку:
— фамилия, имя, отчество;
— почтовый адрес, адрес электронной почты, номер телефона;
— сведения об образовании;
— сведения о месте работы и занимаемой должности.

Персональные данные предоставляются для их хранения и обработки в различных базах данных и информационных системах, включения их в аналитические и статистические отчетности и т.д.
3.2.2. Направлять Заказчику письма на его электронный адрес, а также отправлять Заказчику на его номер мобильного телефона, указанный в Заявке, смс сообщения с информацией, содержащей информацию о мероприятиях, проводимых Исполнителем.
3.3. Заказчик обязан:
3.3.1. Оплатить организационный взнос на участие в Международной конференции «Физические интерпретации теории относительности PIRT-2023» в соответствии с расценками, указанными на сайте https://pirt.bmstu.ru/ в разделе «Основная информация» банковским переводом денежных средств на расчетный счет Исполнителя, комиссия за перевод средств списывается со счета Заказчика. Оплата производится до окончания срока, указанного на сайте https://pirt.bmstu.ru/ в разделе «Основная информация».
3.4. Заказчик имеет право:
3.4.1. Отозвать согласие на передачу своих персональных данных третьим лицам путем направления соответствующего письменного уведомления Исполнителю.
3.4.2. Отказаться от участия в Конференции до даты начала его проведения, указанной на сайте: https://pirt.bmstu.ru/.

4. АКЦЕПТ ОФЕРТЫ И ЗАКЛЮЧЕНИЕ ДОГОВОРА

4.1. Заказчик производит Акцепт Оферты путем проставления галочки в графе «Я согласен с условиями публичной оферты» и нажатием кнопки «Отправить заявку» на сайте: https://pirt.bmstu.ru/.
4.2. Оферта считается принятой Заказчиком и Договор заключенным Сторонами с момента выполнения Заказчиком совокупности следующих действий:

а) Подачи заявки на участие в Конференции в электронной форме на сайте Конференции. Направление заявки является основанием для выставления счета на заказанные услуги.
б) Оплаты Заказчиком услуг Исполнителя в течение Срока действия оферты, указанного в пункте 5.1 настоящего Договора.

5. СРОК ДЕЙСТВИЯ И ИЗМЕНЕНИЕ УСЛОВИЙ ОФЕРТЫ

5.1. Оферта вступает в силу с момента ее опубликования в сети Интернет по адресу: https://pirt.bmstu.ru/ и действует до момента отзыва Оферты Исполнителем.

6. СРОК ДЕЙСТВИЯ И ИЗМЕНЕНИЕ ДОГОВОРА

6.1. Договор вступает в силу с момента Акцепта Оферты Заказчиком и действует до момента исполнения Сторонами их обязательств;
6.2. Исполнитель соглашается и признает, что внесение изменений в Оферту влечет за собой внесение этих изменений в заключенный и действующий между Исполнителем и Заказчиком договор, и эти изменения вступают в силу одновременно с такими изменениями в Оферте.
6.3. В случае отзыва Оферты Исполнителем в течение срока действия договора, договор считается прекращенным с момента отзыва. Услуги, оплаченные Заказчиком на момент отзыва Оферты, подлежат исполнению в полном объеме.

7. СТОИМОСТЬ УСЛУГ И ПОРЯДОК РАСЧЕТОВ

7.1. Стоимость (Перечень) Услуг Исполнителя указана на сайте Конференции по адресу: https://pirt.bmstu.ru/ и зависит от вида и количества оказываемых Исполнителем Услуг. Оплата Услуг производится в виде 100% предоплаты путем перевода средств на расчетный счет Исполнителя не позднее Срока действия оферты, с обязательным указанием в квитанции/платежном поручении фамилии, имени и отчества Заказчика (Заказчиков), участвующего в Конференции.
7.2. При оплате Услуг в Квитанции Заказчик указывает в назначении платежа следующее: «Оплата Услуг по организации участия в Международной конференции PIRT-2023, в т.ч. НДС 20%».
7.3. Стоимость Услуг на участие в Конференции включает в себя предоставление Заказчику раздаточных материалов и организацию кофе-паузы.
8. РАСТОРЖЕНИЕ ДОГОВОРА
8.1. Договор может быть расторгнут досрочно:
8.1.1. По соглашению Сторон в любое время.
8.1.2. По иным основаниям, предусмотренным настоящей Офертой.
8.2. Прекращение срока действия договора по любому основанию не освобождает Стороны от ответственности за нарушения условий договора, возникшие в течение срока его действия.

9. ОТВЕТСТВЕННОСТЬ СТОРОН

9.1. Заказчик и Исполнитель несут в соответствии с действующим законодательством РФ имущественную и иную юридическую ответственность за неисполнение или ненадлежащее исполнение своих обязательств по настоящему договору.

9.2. Сторона, ненадлежащим образом исполнившая или не исполнившая свои обязанности по настоящему договору, обязана возместить убытки, причиненные другой Стороне.

10. ЗАКЛЮЧИТЕЛЬНЫЕ ПОЛОЖЕНИЯ

10.1. Претензионный порядок досудебного урегулирования споров из настоящего договора является для Сторон обязательным.
10.2. Претензионные письма направляются Исполнителю электронным почтовым отправлением по адресу: dekan-fn@mail.ru, Заказчику – по электронному адресу, указанному в заявке.
10.3. Срок рассмотрения претензионного письма составляет 10 рабочих дней со дня получения последнего адресатом.
10.4. Настоящий договор вступает в силу с момента принятия Заказчиком оферты на сайте Исполнителя.
10.5. Во всем, что не предусмотрено настоящим договором, Стороны руководствуются нормами действующего законодательства РФ.
